These Speedax Terms and Conditions contained herein("T&C") contain the complete and entire terms and conditions that apply to a client and govern the Client's access to, and use of the Platform as defined below.

By using our Services, you agree to these terms. Please read these Terms and Conditions ("Terms", "T&C", "Terms and Conditions") carefully before using the http://www.gandaria.biz (Our website) and Speedax (the mobile application) operated by Speedax Global Systems Limited ("us", "we", or "our").

Our Services are very diverse, consequently, sometimes additional terms or product requirements (including age requirements) may apply. Additional terms will be available with the relevant Services, and those additional terms become part of your agreement with us if you use those Services. You also agree to comply with the following additional policies that apply to you:

"Counterparty" means any person with which the Client enters into an agreement, contract or arrangement with pertaining to the services or platform.

"Force Majeure Event" includes any act, event, non-occurring, omission or accident beyond the control of Speedax. These includes strikes, lockouts, and other industrial action, riot, invasion, fire, terrorist attack, war declared or not)

"Platform" means the Speedax platform; including sub platforms launched by Speedax.

"Speedax" means Speedax Global Systems Limited; a private limited company duly registered under CAMA (Companies and Allied Matters Act) and under the extant laws of the Federal Republic of Nigeria.

"Personal Data" shall have the meaning as ascribed to the term under the applicable data protection laws.

"Services" means the products and services offered by Speedax Global Systems Limited through the Speedax platform

Our products and services

We offer a plethora of payment solutions services ranging from money transfer and remittance, foreign currency exchange, invoice settlement (B2B, B2C), cross border payments etc.

Acceptance of Terms and Conditions

By using our services, you acknowledge that you have reviewed, considered the Terms of this Agreement and understand same as well as agree to be bound by the same Terms. If you do not subscribe to these Terms or do not intend to be bound, you are adviced to immediately cease the use of these products.

You must follow any policies made available to you within the Services. You also guarantee that you won't misuse our Services. For example, don't interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only within the confines of the relevant and applicable law(s).

You further represent and warrant that you are a consenting individual and have the legal capacity to accept these Terms. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we suspect misconduct or misuse of our products or services.

Software in our Services

When a Service requires or includes downloadable software, this software may update automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings.

Speedax Global Systems Limited gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive access to the software provided to you as part of the Services. This permission is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Speedax in the manner permitted by these terms.

Disclaimer, Exclusions and Limitations

The information contained on this website is provided on an "as is" basis. To the fullest extent permitted by law, this company:

To the extent permitted by law, the total liability of Speedax for any claims under these Terms, including for any implied warranties, is limited to the amount (If any) you paid us to use the Services.

In all cases, Speedax will not be liable for any loss or damage that is not reasonably foreseeable.

Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Speedax and its affiliates, stakeholders, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees.

Modifying and Terminating our Services

We are constantly changing and improving our Services to stay ahead and guarantee a robust User experience. This may require us to add or remove functionalities or features, and we may suspend or stop a Service altogether.

The Customer and Speedax have the right to terminate any Service Agreement for any reason whatsoever, including the termination of services already in progress. Speedax may also stop providing Services to you or add or create new limits to our Services at any time.

Refunds Policy

No refund will be offered when a service is deemed to have commenced and is, for all intents and purposes, in progress. Any amount paid to us that constitutes payment for the provision of unused Services, will be refunded.

Log Files

We use IP addresses to analyse trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

Force Majeure

No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.
